Introduction

The terms “We”, “Us”, “Our”, or “Company” refer to HolidayPartner.in, and “You” or “User” refers to any person accessing or using our website and services.

These Terms & Conditions constitute a legally binding agreement between you and HolidayPartner.in and are governed by the provisions of the Information Technology Act, 2000, along with applicable rules and amendments. By accessing, browsing, or using this website, you acknowledge that you have read, understood, and agreed to be bound by these Terms & Conditions.

Your continued use of HolidayPartner.in signifies your acceptance of all terms, policies, and notices stated herein. If you do not agree with any part of these Terms & Conditions, you are advised to discontinue use of the website immediately. HolidayPartner.in reserves the right to modify, update, or change these Terms & Conditions at any time without prior notice.

Any changes will be effective immediately upon posting on the website, and your continued use will constitute acceptance of the revised terms. The website may contain links to third-party websites or services. HolidayPartner.in is not responsible for the content, policies, or practices of such external websites, and users are encouraged to review their respective terms independently.

Definitions & Interpretation

In these Terms and Conditions (“Agreement”), unless the context otherwise requires:

– “Agency” / “Company” means Kaanha Travels, operating under the brand HolidayPartner.in
– “Client” / “You” means any individual or entity booking travel services
– “Services” means travel-related services provided by the Agency
– “Force Majeure” means events beyond reasonable control including natural disasters, strikes, political unrest, pandemics, or government actions

(Hereinafter referred to as “HolidayPartner.in” or “Agency”)

Scope of services

The Agency provides travel-related services including but not limited to:

– Group tours (domestic and international)
– Customized travel itineraries
– Backpacking and biking trips
– Accommodation assistance
– Tours, activities, and sightseeing arrangements
– Ancillary travel support services
– Visa assistance

The Agency acts solely as a facilitator and intermediary between the Client and third-party service providers.

Bookings & Confirmation

4.1 All bookings are subject to availability and confirmation upon receipt of the applicable payment.
4.2 The Client shall provide accurate personal and travel information.
4.3 The Agency reserves the right to reject or cancel bookings due to incomplete information or non-payment.

Payments, Taxes & Government levies

5.1 Payment Terms
Payments shall be made strictly in accordance with Annexure A (Payment & Cancellation Policy). Failure to adhere to payment timelines may result in cancellation without notice.

5.2 Modes of Payment
Payments may be made via bank transfer, credit/debit card, UPI, or other approved modes. Additional charges may apply depending on the payment method.

5.3 Currency
All payments shall be made in INR, calculated at the prevailing exchange rate on the date of final payment.

5.4 Taxes & TCS
Tax Collected at Source (TCS) applies to international travel bookings for Indian residents under the Liberalised Remittance Scheme (LRS).

– 5% TCS applies to international travel bookings on threshold limit of up to ₹10 lakh per financial year.
– 20% TCS applies once international travel expenditure on threshold limit exceeding ₹10 lakh per financial year.

The Client shall indemnify the Agency against any liability arising from non-disclosure of TCS thresholds.

Pricing, Inclusions & Exclusions

6.1 Prices are indicative and subject to availability, exchange rate fluctuations, and vendor pricing.
6.2 Final inclusions and exclusions shall be specified in the booking confirmation.
6.3 Any service not expressly mentioned is deemed excluded.

Cancellation, No-Show & Refunds

7.1 Cancellation
All cancellations must be submitted in writing and shall be governed by Annexure-A.

7.2 No-Show
No refund shall be issued in case of no-show.

7.3 Refunds
Where applicable, refunds shall be processed within 14 working days to the original payment method. Credit notes may be issued at the Agency’s discretion.

Itinerary changes & Tour operations

8.1 The Agency reserves the right to modify itineraries due to operational requirements or Force Majeure events.
8.2 Group tours are subject to minimum participation requirements.
8.3 On-tour changes due to safety, weather, or administrative reasons shall not attract compensation.

Accommodation, Transfers & Sightseeing

9.1 Accommodation
Hotel check-in/check-out timings are governed by hotel policy. Additional charges must be settled directly by the Client.

9.2 Transfers
Transfers operate as per itinerary and are not on a disposable basis.

9.3 Sightseeing
Sightseeing schedules may change due to local conditions. No refund shall be provided for unused services.

Airline & Transport disclaimer

10.1 The Agency is not responsible for flight delays, cancellations, baggage loss, or airline schedule changes.
10.2 Additional airline taxes, fuel surcharges, or government levies shall be borne by the Client.
10.3 Meal inclusions depend on airline policy and ticket type.

Passports, Visas & Travel documents

11.1 The Client is solely responsible for obtaining valid passports, visas, and travel documents.
11.2 Visa approvals are subject to embassy discretion.
11.3 Passports must be valid for at least six months beyond the return date.

Health, Safety & Adventure activities

12.1 Clients must comply with all health requirements and disclose medical conditions prior to booking.
12.2 Participation in adventure activities is entirely at the Client’s own risk.
12.3 The Agency bears no liability for injuries, illness, or death.

Insurance

Clients are strongly advised to obtain comprehensive travel insurance covering medical emergencies, cancellations, baggage loss, and accidents. The Agency shall not be liable for uninsured losses.

Limitation of liability

14.1 The Agency shall not be liable for acts or omissions of third-party service providers.
14.2 The Agency shall not be liable for loss of personal belongings including passports, IDs, or valuables.
14.3 No claim shall arise from Force Majeure events. Annexure B shall apply.

Client conduct & damages

15.1 Clients must adhere to local laws and respectful conduct.
15.2 Misconduct may result in termination of services without refund.
15.3 Clients shall be liable for damages caused by their actions.

Privacy, Data & Media rights

16.1 Client data shall be processed in compliance with applicable Indian laws.
16.2 The Agency may capture photos/videos during tours for promotional purposes.
16.3 Content voluntarily shared by Clients may be used for marketing without compensation.

Amendments & Administrative charges

17.1 Any amendments requested by the Client are subject to availability and additional costs.
17.2 Administrative fees may apply and are non-refundable.
17.3 All amendments must be confirmed in writing.

Force majeure

In the event of Force Majeure, services may be cancelled or rescheduled as per Annexure-B, without liability to the Agency.

Governing law & Jurisdiction

This Agreement shall be governed by the laws of Darbhanga, Bihar. Courts in Darbhanga, Bihar shall have exclusive jurisdiction. Parties agree to attempt mediation prior to litigation.

Entire agreement

This Agreement constitutes the entire understanding between the Client and the Agency and supersedes all prior communications.

Severability

If any provision is held unenforceable, the remaining provisions shall remain in full force and effect.

ANNEXURE-A

PAYMENT & CANCELLATION POLICY

This Payment and Cancellation Policy forms an integral part of the Terms and Conditions and shall be binding on the Client.

A. PAYMENT POLICY

A.1 Payment Schedule

The Client shall make payments in accordance with the schedule set out below:

At the time of booking:  25% of the total tour cost or applicable cancellation charges, whichever is higher (non-refundable and non-transferable)
Within 45 days prior to departure: 50% of the total tour cost or applicable cancellation charges, whichever is higher (non-refundable and non-transferable)
Within 30 days prior to departure: 75% of the total tour cost or applicable cancellation charges, whichever is higher (non-refundable and non-transferable)
20 days prior to departure: 100% of the total tour cost.

A.2 Special Payment Conditions

– Airfare: Full payment of airfare is mandatory prior to issuance of flight tickets.
Non-Refundable Services: Services classified as non-refundable must be paid in full at the time of booking.
Variable Payment Schedules: Payment timelines may vary based on destination, travel dates, peak seasons, special events, or vendor policies.

The Client must confirm the final payment schedule with the assigned sales representative.


B. CANCELLATION POLICY

B.1 Cancellation Charges

In the event of cancellation by the Client, the following charges shall apply:

31 days or more prior to departure: 20% of the total tour cost.
30 to 11 days prior to departure: 50% of the total tour cost (balance amount, if any, shall be issued as a credit note).
– 10 days or less prior to departure: 100% of the total tour cost.

B.2 Important Conditions

Airfare Cancellation: Actual airline cancellation charges shall apply as per airline policy.
Non-Refundable Components: No refund shall be issued for non-refundable services included in the tour package. Applicable 5% or 20% TCS shall also be charged on such components.
GST on Cancellation: Cancellation charges are non-negotiable and subject to 5% GST on the total cancellation amount.
Variable Cancellation Terms: Cancellation charges may vary depending on destination, travel period, peak season, or special events. Clients are advised to reconfirm applicable cancellation terms with their sales representative prior to booking.

ANNEXURE-B

TOUR CANCELLATION & RESCHEDULING POLICY (FORCE MAJEURE)

This Tour Cancellation and Rescheduling Policy forms an integral part of the Terms and Conditions of HolidayPartner.in.

1. Force Majeure

In the event of a Force Majeure Event, including but not limited to natural disasters, pandemics, political unrest, government restrictions, strikes, or any circumstance beyond the reasonable control of the Agency, the booked tour may be rescheduled or cancelled, at the option of the Client, subject to the terms set out herein.

2. Limitation of Agency Liability

2.1 The Agency shall not be liable for any loss, damage, cost, or expense arising from indirect or ancillary travel arrangements, including but not limited to:

– Air tickets
– Visa applications
– Travel insurance
– Pre- or post-tour accommodations
– Any independently booked services

2.2 While the Agency may assist the Client in facilitating flight bookings, visa processing, or insurance arrangements, such services are governed by third-party policies, over which the Agency has no control, and are generally non-refundable.

3. Non-Reimbursement of Third-Party Costs

3.1 Any costs incurred towards flights, visas, or insurance—whether booked through the Agency or independently by the Client—shall not be reimbursed in the event of tour cancellation or rescheduling due to Force Majeure.

3.2 Where any component is refundable as per third-party or vendor policy, the Agency shall pass on such refundable amount to the Client without undue delay.

4. Alternate Arrangements, Credit Notes & Refunds

4.1 Subject to vendor policies and availability, the Agency may assist the Client in:

– Coordinating alternate travel arrangements; or
– Issuing a credit note or partial refund for tour-specific components only

4.2 The choice between rescheduling, credit note, or partial refund shall be subject to vendor terms and exercised at the Client’s discretion, where applicable.

5. Travel Insurance Advisory

Clients are strongly advised to purchase comprehensive travel insurance covering cancellations, travel disruptions, medical emergencies, and related losses. The Agency shall not be responsible for losses that could have been mitigated through appropriate insurance coverage.
